| GENERAL TERMS OF DELIVERY |

1. Should no other special arrangements have been made, there are no
agreements regarding exclusivity or priority for the use of the
photographic material. Therefore, offers are made without engagement, and
after publication of the material the supplier is free to dispose of it in
favor of other publications, etc.
2. Any complaints referring to the contents of the shipment (incompleteness
or corrupted data) must be made to the supplier immediately after receipt of
the shipment.
3. After acceptance of the shipment, the receiver is liable for the
photographic material.
4. Delivery of the photographic material is made at the client's expense.
5. The photographic material may only be used for the reason or publication
agreed upon. Without prior written approval it may not be handed to third
parties, duplicated, or recorded or published in electronic data systems.
6. All fee arrangements are valid only for a one-off publication. Each
further use of the material requires prior approval by the supplier and is
subject to further fees. Fees are charged also for use of the photographic
material in work instructions (layout) or in client proposals.
7. Fees are due latest at the time of use (printing, broadcasting, etc.).
The prices are net. Invoices are payable within 30 days.
8. Changes of the supplied photographic material (by means of montage, a
scanner or essential retouching) are allowed only after prior consultation
with the supplier.
9. Copyright always remains with the photographer. In actual fact, only the
right of use of the photographer's copyright is transferred. Should
photographed objects be subject to copyright in favor of third parties (e.g.
works of art) then it is the client's responsibility to obtain the copyright
from this third party. Furthermore, should photographs be used of persons
who cannot claim to be personalities of contemporary history, then the
client is responsible for obtaining their agreement directly.
10. The supplier rejects any liability resulting from the use of the
photographic material. The publisher of the respective print media or other
media carries the risk in all cases of using the supplied material in breach
of contract, and in an internal relationship he is also liable for the claim
which the supplier is entitled to in the case of utilization in breach of
contract, as well as for the supplier's expenditure required to defend such
claims.
11. When published, the photographs are to be clearly and unmistakably
marked with the byline: "Photo: Name First Name / remote.ch" In case of
omission, a 100-percent surcharge will be made on the prices agreed on, or
on the fees contractually agreed on. This regulation does not apply to
insertions in television, films or slide shows; for advertising purposes
this regulation falls away only if a special agreement has been made.
12. For each contravention of contractual obligations on behalf of the
client, the client owes the supplier CHF 1000.- as a contractual penalty;
payment of the contractual penalty does not release the client from keeping
to or fulfilling the respective obligation.
13. For any disputes resulting from this agreement, the supplier's domicile
is taken as place of jurisdiction. However, the supplier may also choose the
courts of law at the client's domicile. Swiss law applies.
